1. About these terms

These terms apply when you use anytimegolfsims.com or anytimegolfleagues.com, book a bay, buy a membership or gift card, or visit an Anytime Golf location. By creating an account, making a booking or entering a location, you agree to them.

Who we are. The websites are operated by Anytime Golf Inc., 1 Nightingale Dr, Brantford, ON N3T 0G2 ("Anytime Golf", "we", "us").

Independently owned locations. Most Anytime Golf locations are independently owned and operated under a franchise agreement. When you book a bay or buy a membership for a location, you are buying from the operator of that location, and payment is processed for that operator. Anytime Golf provides the website and booking system.

Other documents that apply. Our Privacy Policy, the Release and Waiver of Liability you accept before your first visit, and the league rules for any league you join. If one of those documents conflicts with these terms on its own subject, that document applies.

2. Accounts and bookings

• You must be at least 18 to create an account, make a booking or hold a membership. Guests under 18 must be with an adult who stays at the location for the whole booking.
• Keep your login and door code to yourself. You are responsible for everything done through your account and for everyone you let into a location.
• A booking is confirmed only when you receive a confirmation email. Check the location, date, time and bay before you pay.
• Bookings are for the times shown. Your bay may be needed by the next customer, so please finish on time.
• We may cancel a booking that breaks these terms, was made with incorrect information, or can't go ahead because of a problem at the location. If we or the location cancel for a reason that is not your fault, you get a full refund or credit.

3. Payments, cancellations and refunds

• Prices are in Canadian dollars and are set by each location. Applicable taxes are added at checkout.
• Payments are processed by Stripe. We do not store your full card number.
• Cancelling a booking: you can cancel through your account up to 4 hours before the start time for a full refund to the payment method you used. Cancellations after that, and no-shows, are not refunded.
• Discounts: one discount per booking. Discount codes have no cash value and can't be combined unless the offer says so.
• Refunds go back to the original payment method and can take 5 to 10 business days to appear.
• If you think you were charged in error, contact us within 30 days.

4. Memberships and gift cards

Memberships

• Each membership is sold by a location and is for use at that location only, unless its description says otherwise. Benefits, price and term are shown at checkout.
• Memberships are personal and can't be shared or transferred.
• Memberships do not renew automatically. To continue after your term ends, buy a new membership.
• Memberships are non-refundable once the term has started, except where the law requires otherwise.
• Coming Soon locations: you can buy a membership before a location opens. Its term is counted from the day the location opens, not the day you buy it, so your expiry date is set from the opening date.

Gift cards

• Gift cards are in dollar amounts, do not expire and have no fees.
• Gift cards can be used at any Anytime Golf location. They can't be exchanged for cash, except where the law requires it. Gift cards bought through Costco can't be used to buy memberships.
• Treat a gift card code like cash. We can't replace a code that someone else has used.
• Gift cards given as league prizes follow the league rules for that league.

5. Using the locations

Most locations are self-serve and may not have staff on site. By booking, you agree to:

• Accept the Release and Waiver of Liability before your first visit.
• Use your door access only for your own booking, and not let in anyone who isn't part of your group.
• Hit only from the hitting area, at the screen, with proper golf clubs and the balls provided or approved by the location. Make sure no one is in front of or beside you before you swing.
• Follow the location's posted rules. Alcohol, cannabis, smoking and vaping are not allowed.
• Leave the bay as you found it and report any damage or equipment problem right away.
• Pay for damage caused by you or your group beyond normal wear, such as a broken screen, projector or launch monitor from misuse. As set out in the house rules, you authorize the location to charge up to $400 for damage to the payment method used for your booking. We will tell you what was damaged when we charge you.

Cameras. Locations use security cameras, and bays can be viewed remotely for support. Footage is kept for about 30 days, as set out in the Privacy Policy.

If something goes wrong. If the door, bay or simulator doesn't work, contact support right away. If the problem can't be fixed and you lose time from your booking, you get a refund or credit for the time lost.

We or the location may ask you to leave, cancel future bookings, or close your account if you break these rules, without a refund.

6. Leagues

Leagues on anytimegolfleagues.com are run by Anytime Golf Inc. Entry fees, prizes, handicaps and refunds for each league follow the league rules posted for that league. Your name, scores and standings may be shown on public leaderboards and on screens at the locations.

7. The websites

• Don't misuse the websites. That includes trying to get into other accounts, interfering with bookings or door access, or scraping data.
• The websites, booking system, logos and content belong to Anytime Golf Inc. You may not copy them for commercial use.
• We work to keep the websites and door access running, but we can't promise they will always be available. If an outage affects your booking, section 5 applies.

8. Liability

To the extent the law allows, our total liability and the location's total liability to you for any claim is limited to the amount you paid for the booking, membership or gift card the claim relates to. Neither of us is liable for indirect or consequential losses. Personal injury is covered by the Release and Waiver of Liability.

Nothing in these terms takes away rights you have under Ontario's Consumer Protection Act, 2002 or any other consumer law that can't be waived.

9. Privacy

How we and the locations collect and use your information is explained in our Privacy Policy.

10. Changes to these terms

We may update these terms. The new version applies from the date posted on this page. Bookings and memberships already paid for keep the terms that applied when you bought them.

11. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
